GENERAL TERMS AND CONDITIONS OF SALE

The offer and sale of products made on the Website www.amantia.it are governed by these General Conditions of Sale. For any other legal information, consult the sections: General Conditions of Sale, Privacy Policy and Right of Withdrawal. The Customer is required, before submitting his Purchase Order, to carefully read these General Conditions of Sale. The forwarding of the Purchase Order implies full knowledge and express acceptance of both the aforementioned General Conditions of Sale and what is indicated in the Order Form. The Customer is required, once the online purchase procedure has been completed, to print and keep these General Conditions of Sale and the relative Order form, already viewed and accepted.

 

OBJECT

These General Conditions of Sale are for the sale of products made online through an e-commerce service on the www.amantia.it Site. In consideration of the large number of products made available, the main features and prices of the same (including any additional cost) are clearly indicated directly on the Site.

 

SUBJECTS

The products are sold directly by the company Gioielleria Amantia & Figli Srl (VAT 02070630815), in the person of the legal representative Mr. Amantia Pietro, with legal, administrative and operational headquarters in Trapani 91100, via G.B. Fardella, 86/88, REA number Chamber of Commerce of Trapani, TP143380, share capital in euro 115,000.00 (i.v.), address PEC:amantia@pec.it, (hereinafter Seller) which has as its object the retail and wholesale trade of goldsmithing,  costume jewelry, watches, silverware and other products connected and / or similar to the former and makes available to all users the possibility of purchasing products under different brands via the Internet (hereinafter "Products") and also a series of Services, including delivery Services, through the www.amantia.it Site (hereinafter "Site"), of which Amantia & Figli S.r.l. is the sole and exclusive owner.

GENERAL CONDITIONS OF SALE FOR ONLINE PURCHASES ON THE WWW.AMANTIA.IT WEBSITE

These General Conditions of Sale ("General Conditions of Sale") are governed by the Consumer Code (Legislative Decree no. 206/2005 and subsequent amendments) and by the rules on electronic commerce (Legislative Decree no. 70/2003 and subsequent amendments) and apply exclusively to distance selling via the web of the Products shown on the Site, in correspondence with which there is the "Add to cart" button,  and the Services as indicated in these General Conditions of Sale as well as in other sections of the Site. In case of changes to the General Conditions of Sale, to the Purchase Order, as specified in the following articles. 3 and 4 of these General Conditions of Sale (hereinafter "Purchase Order") the General Conditions of Sale published on the Site at the time of sending the Order by the Customer (hereinafter "Customer") will apply.

These General Conditions of Sale govern the offer, forwarding and acceptance of purchase orders for products on www.amantia.it  and do not govern, however, the provision of services or the sale of products by parties other than the Seller that are present on www.amantia.it through links, banners or other hypertext links. Before placing orders and purchasing products and services from parties other than the Seller, we suggest that you check their conditions of sale, because the Seller is not responsible for the provision of services by third parties other than the Seller.

The products are sold to the Customer identified by the data entered when filling in and sending the Order form in electronic format with simultaneous acceptance of these General Conditions of Sale.

The product offers on the Site are aimed at adult customers.  If you are under the age of 18 in order to purchase on the Site you must first have the consent of one of your parents or legal guardian.

Remember: this always applies, not only to our Site, but to all the sites you visit on the Internet: when browsing the Internet you see or are asked for information that you do not understand or are not clear to you, always ask your parents for help.  By placing an Order through this Website, you warrant that you are of legal age (18 years) and have the legal capacity to enter into binding contracts.

The Customer is forbidden to insert false names, and / or invented, and / or fantasy, in the online Order procedure and in further communications. The Seller reserves the right to prosecute any violation or abuse, in the interest and for the protection of all consumers.

By accepting these Conditions of Sale, you also exempt the Seller from any liability arising from the issuance of incorrect tax documents due to errors in the data provided by you when placing the Order online, being yourself as a customer solely responsible for their correct insertion.

By accepting these Conditions of Sale, you also exempt the Seller from any liability deriving from errors or delays in access to the Website by the customer at the time of entering their data in the purchase procedure. As well as the slowness or impossibility of receiving the customer's Order confirmation or any anomaly that may occur due to problems with the Internet, or due to any other unforeseeable event independent of Amantia & Figli S.r.l..

By accepting these Conditions of Sale, you also exempt the Seller from any liability deriving from non-operation or problems related to the e-mail address provided by the customer for sending the Order confirmation.

 

OFFER TO THE PUBLIC AND CONTRACT OF SALE THROUGH E-COMMERCE SERVICE

The Products and Services with the relative Prices as present on the Site, constitute an offer to the public in accordance with the procedures specified in the General Conditions of Sale and in the Site itself. The Conditions of this offer apply exclusively to purchases made on the www.amantia.it Site. The purchase and sale contracts stipulated on the Site and concerning the Products and Services (hereinafter "Sale and Purchase Agreement" or simply "Contract") are concluded with Gioielleria Amantia & Figli S.r.l..

Online Sale Contract means the Distance Contract concerning the sale of movable property (hereinafter Products) stipulated between you, as a Customer, and Gioielleria Amantia & Figli S.r.l., as a Seller, as part of an e-commerce service organized by the Seller which, for this purpose, uses the remote communication technology called Internet.

To conclude the Contract of one or more Products, you must fill out the Order form in electronic format (hereinafter also Order) and send it to the Seller through the Internet following the relevant instructions.

The Order contains:

  • the reference to these General Conditions of Sale;
  • information and images of each Product and its price;
  • the means of payment you can use;
  • the methods of delivery of the Products purchased, the times and related shipping and delivery costs;
  • the reference to the conditions for exercising your right of withdrawal;
  • the methods and times of return of the products purchased.

Although the Seller constantly adopts measures to ensure that the photographs shown on the Site are faithful reproductions of the original products, including the adoption of every possible technological solution to minimize inaccuracies, some variations are always possible due to the technical characteristics and color resolution characteristics of the computer you use. Consequently, the Seller will not be responsible for any inadequacy of the graphic representations of products shown on the Site if due to the aforementioned technical reasons, since these representations are merely illustrative.

 

ORDER FULFILLMENT AND CONCLUSION OF THE CONTRACT

By transmitting the Order through the Website, you unconditionally accept and undertake to observe, in relations with the Seller, these General Conditions of Sale.

Once the Order has been sent, the Seller will take charge of it for its fulfillment and will send you, by e-mail, an Order Confirmation (hereinafter "Order Confirmation") to the e-mail address communicated by the Customer. This Confirmation will summarize the Products and Services chosen, the relative Prices (including Delivery costs and additional expenses related to the additional Services requested by the Customer), the delivery address, the Order number (hereinafter "Order Number"), the General Conditions of Sale provided therein and any Special Conditions applicable to the individual Order and determined following specific requests by the Customer.

Amantia & Figli S.r.l. reminds the Customer to check with the utmost attention and care the correctness of the data contained in the Order Confirmation and to communicate any corrections within 24 (twenty-four) hours of receipt of the same. The Order Number, generated by the system and communicated by the Seller, must be used by the Client in any communication with the staff. It is possible that occasional unavailability of the Products offered may occur, in which case, if the Products chosen by the Client are not, in whole or in part, available, the Seller will notify the Client.

The Seller, before sending the Order Confirmation, may request further information via e-mail or telephone indicated by you with reference to the Order sent by you through the Internet.

The Seller may not process your purchase orders that do not give sufficient guarantees of solvency or that are incomplete or incorrect or in case of unavailability of the products. In these cases, we will inform you by e-mail that the Contract is not concluded and that the Seller has not processed your Order specifying the reasons. In this case, the sum previously committed to the Customer's means of payment will be decommitted.

If the products, presented on the Website, are no longer available or for sale after sending the Order, the Seller will notify you, promptly and in any case within thirty (30) working days from the day following that on which you have sent your Order to the Seller, of any unavailability of the Products ordered. In this case, the sum previously committed to the Customer's means of payment will be decommitted.

Each sale made by the Seller through the online sales service may concern one or more products, without quantity limit for each item.

Before concluding the Contract, you will be asked to confirm that you have read the General Conditions of Sale including the Information on the right of withdrawal and the processing of personal data Privacy Policy.

The Contract is concluded when the Seller, after receiving your Order Form and verifying the correctness of the data, has forwarded you to the e-mail address indicated by you through the Site the confirmation of the shipment of the product.

The Seller undertakes to deliver the ordered products to the Customer no later than 30 days from the date of conclusion of the Contract.

The language available to conclude the Contract with the Seller is Italian and the applicable law is Italian.

The Seller reserves the right to refuse orders from a client with whom there is an ongoing legal dispute relating to a previous Order. This applies equally to all cases in which the same deems the customer unsuitable, including, by way of example, the case of previous violations of the conditions of the Contract for online purchase on the Site or for any other legitimate reason, especially if the customer has been involved in fraudulent activities of any kind.

 

SALES PRICES

Unless otherwise indicated in writing, all prices of the Products and shipping and delivery costs indicated on the Website and in the Order are to be considered VAT included and expressed in Euro. The validity of the prices indicated is always and only that indicated by the Website at the time of transmission of the Order through the Internet. Product prices, offers and costs of shipping and delivery may vary over time. If you send the order after your last visit to the Website, make sure that the prices have not changed and then check the final sale price before submitting the relevant Order.

All Products are shipped directly from Italy. The prices of the Products and  shipping and delivery costs indicated on the Website and in the Order,   unless otherwise specified, are to be considered not inclusive of any costs related to customs duties and related taxes, not previously calculable, if the shipment takes place in non-EU countries or in countries where current legislation provides for import charges. In this case, the existence of any additional costs indicated above will be clearly mentioned during the insertion and revision of the Order.

These costs are therefore charged to the Customer and must be paid directly at the time of delivery of the Products, according to the indications specified in the Order Confirmation.

In case of non-collection, the seller will refund the cost of the product but not also the shipping costs, exit and entry costs related to customs duties and related taxes and shipping costs for shipping the product to the seller.

All Product Prices indicated on the Site include VAT. The delivery costs (hereinafter "Delivery Costs") and the costs related to the additional services made available by Gioielleria Amantia & Figli S.r.l., as indicated in the following articles of these General Conditions of Sale, are charged to the Customer and adequately detailed in the Purchase Order. The Price shown on the Site at the time the Order is sent to the Products and Services, except for offers or any price changes made subsequently and indicated on the Site itself.

 

ORDER

The purchase order must be made online, by clicking on the desired product which will flow into the Shopping Cart. In order to proceed with the compilation of the Purchase Order, the Customer may, alternatively, follow these methods:

In the event that the Customer is already registered on the Site through the appropriate Section, it will be sufficient to enter their login credentials (username and password) by entering them in the "Login" section.

In the event that the Customer is not a user of the Site, it will be sufficient to enter the required data in the appropriate form, necessary to be able to make the Purchase.

Amantia & Figli S.r.l. reminds that the Customer, before proceeding with the Purchase, may at any time become a user of the Site by registering online through the "Register" page (to become a User of the Site).

The Customer correctly concludes the Order Process if the Site does not show any error message (the system cannot detect errors with reference to the data entered by the Customer in the field dedicated to billing and shipping addresses).

In the "Your orders" section you can check the status of your Order which can no longer be modified if it is in the status "in progress", "ready", "shipped" and "closed".

If the Order has not yet been shipped, it is only possible to change the shipping address by contacting customer service by e-mail at ordini@amantia.it. It is advisable to anticipate the request by email to change the shipping address with a telephone contact. In the event that the delivery is not successful, the customer must immediately contact Gioielleria Amantia & Figli S.r.l..

 

PAYMENT METHODS

For the payment of the price of the Products and the relative shipping and delivery costs, you can follow one of the methods indicated in the Order form of the www.amantia.it Site and which are summarized below.

 

Credit cards and prepaid cards

The customer can make payment by credit or debit card Visa, Mastercard, Visa Electron and / or other similar cards through the online payment system of credit cards, PayPal, by bank transfer or by cash on delivery (payment in cash to the courier). Amantia & Figli S.r.l. uses the highest security measures available commercially in the sector. In addition, the payment process takes place on a secure server that uses the SSL (Secure Socket Layer) protocol.

For online orders on our Site we accept both credit card and prepaid card payments (for example, PostePay) without any additional charge on the cost of the product and shipping. It is understood that the Customer must be the holder of a valid credit card at the time of the Order of the Products purchased online and that the name on the credit card must be the same as indicated on the billing data. In the absence of these conditions it will not be possible to proceed with the Order.

At the time of online purchase, together with the Order Confirmation, the reference bank will only make the commitment of the amount relating to the Order from the availability of your credit card. The amount will be immediately debited when sending the payment through the online platform.

At no time during the purchase procedure is Gioielleria Amantia & Figli S.r.l. able to know the information relating to your credit card (for example, the credit card number or the date of its expiry), transmitted via a connection protected by encrypted protocol directly to the Site of the person who manages the electronic payment (bank or PayPal). No computer archive of the Seller will store such data.

 

PayPal

If you have a PayPal account, Gioielleria Amantia & Figli S.r.l. gives you the possibility to make payments directly using the email and password with which you registered on www.paypal.com.

 

Mark

You can pay your Order in cash directly to the courier who will deliver the products. When paying cash on delivery, it is always advisable to prepare cash in precise banknotes and coins. Amantia & Figli Jewelry S.r.l. cannot guarantee that all shipping agents have the rest available for cash payment. Couriers must not in any way ask for tips or amounts in excess of the total order.

Bank transfer

You can pay for your Order quickly and securely using your home banking through the payment platform. The amount will be debited directly from your bank account and the shipment will take place after crediting the account.

The payment of the Order must be made at the time of its forwarding to Gioielleria Amantia & Figli S.r.l. with the possibility that this will be automatically canceled by the seller in the event that the credit is not made no later than 7 (seven) days later.

As for the receipt of payment, or the invoice if subject to VAT, it will be sent by email to the address indicated.

SHIPPING AND DELIVERY METHODS

Each shipment contains:

  • i/the products ordered;
  • any accompanying documentation required according to the country of shipment;
  • any information and marketing material;
  • any gadgets.

The delivery of Products purchased through the Seller's Website can take place in different ways.

 

Delivery to the Customer's home

The products purchased will be delivered by the courier identified by the Seller to the shipping address indicated by the Customer on the Order with insured shipping.

Upon receipt of the goods at home, we ask you to check the integrity of the packages at the time of delivery by the courier. In case of anomalies you will have to detect and note exactly the same by the courier and reject the delivery after mandatory communication to Gioielleria Amantia & Figli S.r.l. also by contacting customer service by e-mail to ordini@amantia.it.

 

In Italy we ship by express courier in 24/72 hours with insured delivery and signature on delivery. Abroad we ship by express courier and times vary depending on the country. When the Order is shipped, you will receive an e-mail with the tracking code of the shipment, i.e. the tracking code with a link that refers to the courier's Site and the status of the shipment. This number, the tracking code, is used to monitor the progress of the shipment and the expected date of delivery. Orders with items immediately available, with payment made by credit card, PayPal or cash on delivery made before 16:00 are shipped by the same evening or within 24 hours if the item is in one of our stores. For all orders that include items in reservation the date is indicated at the time of Order confirmation.

 

RIGHT OF WITHDRAWAL

If the Customer is a "Consumer", as defined in Article 3 of the Consumer Code, he is entitled to the rights referred to in art. 52 et seq. of the Consumer Code, as amended by Legislative Decree no. 21 of 21/02/2014, and therefore the right to withdraw from the Purchase Contract (hereinafter "Right of Withdrawal") for any reason, without explanation and without any penalty, communicating it to the Seller within fourteen (14) days, starting from the day on which the Customer or a third party,  designated by the Customer and other than the Carrier, acquires physical possession of the goods.

We remind you that, as required by current legislation, the right of withdrawal is excluded and can therefore not be exercised in the event that the products you have purchased have been personalized, even with simple engravings, or have been made to measure for you, at your explicit request at the time of placing the Order.

The Withdrawal may concern all (Total Withdrawal) or only part (Partial Withdrawal) of the Products of Amantia & Figli S.r.l. Jewelry purchased by the Consumer.

The customer who intends to exercise the right of withdrawal must communicate it, within fourteen (14) days from the day of receipt of the Product, to Gioielleria Amantia & Figli S.r.l. by explicit declaration by sending an email to ordini@amantia.it or by accessing the Site www.amantia.it the "Return Policy" section and using the instructions contained therein in the "HOW TO RETURN" section.

 

The right of withdrawal is subject to the following conditions:

  • the returned Products must be returned in their entirety and not parts or components of them even in the case of kits;
  • the returned Products must not have been used, worn, washed or damaged;
  • Returned products must be returned in their original packaging (meaning, by this, the packaging of the individual product);
  • the returned Products must be sent to the Seller in a single shipment;
  • In the event that the returned product(s) has contributed to the achievement of a minimum order for obtaining a gift, with the return of the product the return of the aforementioned gift is considered included and mandatory.

 

Withdrawal Policy

In case of exercise of the right of withdrawal, the customer is required to return the goods within 14 days from the day on which he communicated to Gioielleria Amantia & Figli S.r.l. his intention to withdraw from the Contract pursuant to art. 57 of Legislative Decree 206/2005.

You can ask for a refund or an exchange: ask for a refund if you want the refund of the amount spent on the items you want to return; ask for a Gift Card in case you want to exchange an item. The Gift Card can also be used immediately by placing an Order on the Site. The new Order will be shipped by Gioielleria Amantia & Figli S.r.l. only after receiving the items to be returned.

It is important that you contact customer service by e-mail to ordini@amantia.it to inform us of your decision (Refund or Exchange), the reason for the return, the purchase invoice and indicate the day on which you want the courier to come to collect the package and the time slot, morning or afternoon.

You will have to put the items to be returned inside a well-sealed and protected box or envelope. The courier will already have the label with our shipping address and the reference of the customer who made the order, so it is not necessary to write anything on the package.

The goods must be returned intact, in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc.) and complete with the attached tax documentation. Without prejudice to the right to verify compliance with the above, Gioielleria Amantia & Figli S.r.l. will refund the amount of the products subject to withdrawal within a maximum period of 30 days, including any shipping costs.

As required by current legislation, to which we refer, Gioielleria Amantia & Figli S.r.l. may suspend the reimbursement until receipt of the goods or, at its sole discretion, until the customer demonstrates that he has sent the goods back to Gioielleria Amantia & Figli S.r.l..

According to Article 59 of the Consumer Code (containing "Exceptions to the right of withdrawal") for distance and off-premises contracts, the right of withdrawal is excluded in the case of "supply of goods made to measure or clearly personalized".

 

Refund Policy

If the right of withdrawal is exercised by you in accordance with the previous conditions, the Seller is required to reimburse the sums paid by the customer no later than 30 days of your decision to exercise the right of withdrawal but provided that within the same term the product has been returned and verified by the operators of Gioielleria Amantia & Figli S.r.l..

The Seller will use the same means of payment used for the initial transaction for the re-credit, unless you explicitly ask the Seller to use a different means and the latter consents. If the Order has been paid by PayPal, the refund will be made to the card or account used for payment while if the Order has been paid by Credit Card, the refund will be made to the card used for payment (it is not possible to use another card for reimbursement). If the Order has been paid by bank transfer, the refund will be made by bank transfer: in this case in the email to be sent to ordini@amantia.it as a return request, also inform us of the IBAN on which to make the transfer. If the Order has been paid by cash on delivery (cash payment to the courier), the refund will be made by bank transfer: in this case in the email to be sent  to ordini@amantia.it as a return request, inform us of the IBAN on which to make the transfer. Returns are processed by customer service in about one business week. The timing of reimbursement on the card or on current accounts depends directly on the banks, which generally take about 2/3 working days for crediting.

In case of simple withdrawal, the only costs at your expense will remain the initial shipping costs of the Order of the products purchased. If you have chosen a different and more expensive type of delivery than the standard one offered, the additional costs will not be refunded. All other expenses will be reimbursed to you by the Seller, including the costs of delivery of the goods returned following the exercise of the right of withdrawal (with the exception of the additional costs deriving from your possible choice to use a different and more expensive delivery method than the standard type of delivery offered by the Seller).

The only case in which the customer will be entitled to a refund of the price, shipping costs and return costs is for the return of defective products or products delivered that do not correspond to the Order placed by the customer himself or in case of damage to them due to transport or errors in shipment by the Seller himself. In case of return of the products listed above, Gioielleria Amantia & Figli S.r.l. will bear the transport costs for returning the products. The return can be requested within 14 days of receipt of the items. If possible, close the item or items to be returned in the same box used for our shipment, if it is not possible we recommend for a matter of security that the return is well packaged and protected. The courier will already arrive with him the pre-printed label with our data for shipping and customer reference.

 

Exchange of products, Good value (Gift Card)

If the right of withdrawal is exercised by you in accordance with the previous conditions, you can choose to request a refund or, always through the return process, you can opt for obtaining a voucher (Gift Card), of equal value of the amount you spent, to be used for a new and different purchase on the website www.amantia.it, just indicate it in the email to be sent to ordini@amantia.it . Remember that the voucher must be used within the deadline of twelve months from the date of issue and, therefore, after its expiry it will no longer be usable and you can no longer be refunded.


 

LEGAL GUARANTEE OF CONFORMITY

All Products sold on the Site are covered by the Legal Guarantee of Conformity provided for by Articles. 128-135 of the Consumer Code (Legal Guarantee).

More precisely, the guarantee regime on products sold by Gioielleria Amantia & Figli S.r.l. differs depending on whether the buyer is a "consumer" or a "professional" within the meaning of Directive 1999/44 / EC concerning "certain aspects of sales contracts and guarantees concerning consumer goods".

If you purchase as a "consumer", you benefit from the legal guarantee of conformity to which the seller is required by law on each good sold ("Legal Guarantee").

The Legal Guarantee - to which Amantia & Figli S.r.l. is required as seller - guarantees the goods from defects of conformity with respect to the sales contract.

 

TO WHOM IT APPLIES

The Legal Guarantee, therefore, is reserved for consumers. Therefore, it applies only to users who have made a purchase on the Site for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out. To those who have purchased on the Site and who do not have the quality of consumers will be applied the guarantees for defects of the thing sold, the guarantee for defects of quality promised and essential and the other guarantees provided for by the civil code with the relative terms, forfeitures and limitations.

 

WHEN TO APPLY

The seller (and, therefore, with regard to purchases made on the Site www.amantia.it) is liable to the consumer for any lack of conformity existing at the time of delivery of the product and which occurs within two years of such delivery. The lack of conformity must be reported to the seller, under penalty of forfeiture of the warranty, within two months from the date on which it was discovered.

The warranty is valid, therefore, provided that the following conditions are met:

  • the defect becomes apparent within 24 months from the date of delivery of the products;
  • the Customer submits a formal complaint regarding the defects within a maximum of 2 months from the date on which the defect was recognized by the latter, unless this is contrary to the prevailing mandatory rules of the Customer's country of habitual residence;

Unless proven otherwise, it is presumed that the lack of conformity that becomes apparent within six months of delivery of the product already existed on that date, unless this hypothesis is incompatible with the nature of the product or with the nature of the lack of conformity. Starting from the seventh month following delivery of the product, it will instead be the consumer's responsibility to prove that the lack of conformity already existed at the time of delivery of the same.

In order to take advantage of the Legal Guarantee, you must therefore first provide proof of the date of purchase and delivery of the goods. It is therefore advisable that you, for the purposes of this proof, keep the purchase invoice or any other document that can certify the date of purchase (for example the credit card statement) and the date of delivery.

 

WHAT IS A LACK OF CONFORMITY

There is a lack of conformity, when the purchased good:

  • it is not suitable for the use for which goods of the same type are normally used;
  • does not conform to the description given by the seller and does not possess the qualities of the goods that the seller has presented to the consumer as a sample or model;
  • does not have the usual qualities and performances of goods of the same type, which the consumer can reasonably expect, also taking into account the statements made in advertising or labelling;
  • it is not suitable for the particular use desired by the consumer and that has been brought to the attention of the seller at the time of conclusion of the Contract and that the seller has accepted.

Any failures or malfunctions or other defects caused by accidental events or by your responsibilities or by a use of the product that does not comply with its intended use and / or as provided in the technical documentation attached to the product, if any, or in the instructions for use relating to the same, are therefore excluded from the scope of the Legal Guarantee. As for watches, accessories such as strap, case and glass are generally not covered by warranty.

We also remind you that although Gioielleria Amantia & Figli S.r.l. constantly adopts measures to ensure that the photographs of the products shown on the Site are faithful reproductions of the original products, including the adoption of every possible technological solution to minimize inaccuracies, some variations are always possible due to the technical characteristics and color resolution characteristics of the computer you have.  used. Consequently, the Seller will not be responsible for any inadequacy of the graphic representations of products shown on the Site if due to the aforementioned technical reasons, since these representations are merely illustrative.

 

WHAT TO DO IN THE PRESENCE OF A LACK OF CONFORMITY

In case of lack of conformity duly reported in the terms, you will be entitled:

  • Primarily, to the repair or free replacement of the goods, at your choice, unless the remedy requested is objectively impossible or excessively burdensome compared to the other and, therefore, in the specific case, considering the type of sale, to the replacement, where this is possible in relation to the number of specimens still available for sale;
  • Secondly (i.e. in the event that the repair or replacement is impossible or excessively expensive or the repair or replacement has not been carried out within a reasonable time or the repair or replacement previously carried out has caused significant inconvenience to the consumer) to the price reduction or termination of the Contract, at your choice.

An excessively onerous remedy is understood to be that which imposes unreasonable expenses on the seller compared to the alternative remedies that can be exercised, taking into account (i) the value that the goods would have if there were no lack of conformity; (ii) the extent of the lack of conformity; (iii) whether the alternative remedy can be used without significant inconvenience to the consumer.

 

REIMBURSEMENT OR REDUCTION AS A RESULT OF THE APPLICATION OF THE LEGAL GUARANTEE

In case of termination of the Contract, Gioielleria Amantia & Figli S.r.l. will refund the Total paid. In case of price reduction, Gioielleria Amantia & Figli S.r.l. will refund the amount of the reduction previously agreed.

The amount of the refund or reduction will be communicated to you by email and credited to the chosen means or payment solution.

In particular, in the event of non-conformity, the Customer who has entered into the Contract as a Consumer will have the right to obtain the restoration of conformity of the products without charge, by repair or replacement, or to obtain an appropriate price reduction or the termination of the Contract in relation to the disputed goods and the consequent refund of the price

The exchange or refund of a product with obvious manufacturing defects will be possible within 7 (seven) days of receipt of the same, beyond these times, if the item falls within the specifications of the service centers (different for each brand) it can be brought for repair under warranty. Warranty repair times vary by product brand and can range from 45 to 60 business days.

COMMUNICATIONS TO THE CUSTOMER

The Customer acknowledges, accepts and gives his consent to the fact that all communications, notifications, attestations, information, reports and in any case any documentation on the operations performed, referring to the purchase of the Products, will be sent to the e-mail address indicated at the time of registration, with the possibility of downloading the information on a durable medium in the manner and within the limits established by the Site.

APPLICABLE LAW, DISPUTE RESOLUTION AND JURISDICTION

These General Conditions of Sale are governed by Italian law and will be interpreted according to it. Consequently, the interpretation, execution and termination of the General Conditions of Sale are subject exclusively to Italian law and any disputes inherent and / or consequent to the same must be resolved exclusively by the Italian judicial authority, as better specified below. In particular, if the Customer qualifies as a Consumer, any disputes must be resolved by the court of the place of domicile or residence of the same according to applicable law. If the Customer, on the other hand, does not hold the status of consumer, the parties conventionally establish the exclusive jurisdiction of the Court of Trapani.

Given that Amantia & Figli Jewelry S.r.l. is always available to seek an amicable solution to disputes arising, also through the direct contacts indicated, the Customer is informed that, according to Article 14 of EU Regulation no. 524/2013 and the resolution on ODR referred to in Statutory Instrument no. 500/2015 in force since 15 February 2016,  an online platform has been established by the European Commission for the resolution of ODR ("online dispute resolution") disputes deriving from the purchase of goods online accessible at the following link:

On the occasion of any modification to these General Conditions of Sale, Gioielleria Amantia & Figli S.r.l. will promptly publish those modified on the Site.

The modified General Conditions of Sale will become an integral part of the new Contracts, starting from the first Order submitted by the Customers, following their publication on the Site. In the case of Orders already submitted before such communication, the previous version of the General Conditions of Sale will apply.

 

SUBSTITUTION CLAUSE

Should a present or future provision of the General Conditions of Sale and/or the Contract be or become wholly or partly null and/or ineffective or there is a gap in the provisions of the General Conditions of Sale and/or the Contract, the remaining provisions of the General Conditions of Sale and the Contract shall in any case remain valid and effective. It is understood that Amantia & Figli Jewelry S.r.l. and the Customer will undertake to negotiate in good faith the integration of the gap or the replacement of the null and / or ineffective clause with the aim of achieving the same results pursued by the invalid or ineffective clause and to safeguard the content, including economic, of the Contract.
